Insolvency and Restructuring

Insolvency proceedings allow a distressed company to restructure its debts or wind up in an orderly way before a single judge, treating creditors of the same class equally. We act for debtors and creditors under Law 1116 of 2006 and Law 2437 of 2024, and for individuals under Law 2445 of 2025.

Questions about insolvency and restructuring

What is the difference between reorganisation and liquidation?
Reorganisation seeks to preserve a viable business through an agreement with creditors on payment terms, while the company keeps operating. Liquidation applies when recovery is not possible: the assets are sold and the proceeds distributed among creditors according to the statutory order of priority.
What happens to enforcement actions when a company enters reorganisation?
Once the proceeding opens, no new enforcement claims can be admitted against the debtor, and pending ones are transferred to the insolvency judge. Creditors of the same class are then paid on equal terms, rather than according to who sued first.

Need counsel on insolvency and restructuring?

An initial conversation is enough to establish whether the matter calls for ongoing counsel, a one-off intervention, or simply a second reading.
